This opinion might anger some of you, but whether you like President Trump or not, he is in the process of strengthening the efficiency of the government by cutting out the waste and enhancing its functionality. If this angers you, then you must ask yourself, “why would I be against a more efficient and less wasteful government”?
That being said, the Executive branch is the Law Enforcement Branch, and the FBI (Federal Bureau of Investigation) is, when non-politicized, without a doubt, the best investigative and law enforcement entity in the world. Now, the DOJ (Department of Justice (Justice being the key word here)), should never have been put under the Executive Branch when it was created in 1870, but under the Judicial Branch. Here is my reasoning….
Lady Justice is an allegorical personification of the moral force in judicial systems. Her attributes are scales, a sword and sometimes a blindfold. (Wikipedia) (Notice the words Justice and Judicial) …..
One of the most recognized legal symbols visible in the architecture of the Supreme Court Building is the female figure representing Justice.
She is blind and balanced…..
Separation of powers…. Checks and balances…. No President could weaponize the DOJ if it was under the Judicial Branch. The FBI investigates and the DOJ indicts. My point being that if the DOJ was under the Judicial Branch instead of the Executive Branch, weaponization would be, at least, much harder, if governed by the Supreme Court. Inditements would be constitutionally verified immediately, or if challenged, settled quickly, and if found constitutional, a Grand Jury would be established and then the FBI would take over for investigation and arrest. There is absolutely no reason for the DOJ to do any investigation. That is the job of the FBI.
